Published California Court of Appeal Decision
Johnson v. Connie, LLC
Jeffrey Wilens and Macy Wilens represented the tenant/appellant in a dispute arising from an allegedly unlawful rent increase.
The California Court of Appeal concluded there was sufficient evidence for the tenant's Penal Code section 496 claim to be considered by the jury. The appellate court reversed the judgment as to that claim and remanded the matter for further proceedings.
An appellate reversal and remand is not a final monetary recovery and does not determine the ultimate outcome of the case.
